Description

This article examines the intersection of family mediation, gender vulnerability, and the Protocol for Judging with a Gender Perspective, exploring how collaborative practices can be adapted to recognize and mitigate structural gender inequalities in family law disputes. The main objective is to analyze how mediation can serve as a transformative tool in promoting gender equity, while critically assessing the lack of specific guidelines for mediation within the Brazilian National Council of Justice (CNJ) Protocol. The study proposes an integrated approach, combining the Protocol's principles with practical measures such as targeted mediator training and the creation of mechanisms to minimize the impact of gender-based vulnerabilities. The methodology includes bibliographic research and critical analysis of legal and sociological literature, drawing on foundational works such as The Second Sex by Simone de Beauvoir and The Shelf of Love: On Women, Men and Relationships by Valeska Zanello. Empirical studies and specialized articles further illustrate how gender-sensitive collaborative practices can be incorporated into family mediation. Expected outcomes include the proposal of specific guidelines for mediators inspired by the Protocol and the identification of strategies that foster fairer and more balanced deliberations. By bridging theory and practice, this study aims to enhance public policy and contribute to the training of professionals committed to social justice in family law.
